Jury awards $4.28 million to family of pedestrian killed in accident
A Harris County jury has awarded $4.28 million to the family of a man killed by a van that ran over a curb while he was standing on the sidewalk.
David Peterson, 52, was standing outside his son’s home, a halfway house for convicts newly released from prison, when Victoria Esparza drove a van over the curb, hitting two parked cars and striking Peterson, who was fatally injured.
Peterson’s family sued Esparza and her employer, American Habilitation Service Inc., alleging that Esparza was negligent and AHS negligently hired her, in that she had had two at-fault accidents within a three-year period.
The jury on June 1 found the defendants liable but did not find that Esparza was grossly negligent.
